Terms of Service
These Terms of Service (“Terms”) are a binding agreement between you and Home Tracker, Inc. (“Home Tracker,” “we,” “us”) governing your access to and use of the Home Tracker mobile application, website, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility and Accounts
You must be at least 18 years old to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
3. Description of the Service
Home Tracker helps you document your home, track maintenance and warranties, store related documents, and generate a Home Health Score and reports. Features and availability may change over time as we improve the Service.
4. Subscriptions and Billing
The Service offers a free tier for a single home and paid tiers for managing multiple or commercial properties.
- Paid subscriptions are billed in advance on a recurring basis through your app store or our payment processor and renew automatically until canceled.
- You may cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law.
- We may change pricing with reasonable advance notice; changes apply to subsequent billing periods.
5. The Home Health Score
The Home Health Score and related recommendations are informational estimates generated from the data you provide and general assumptions about typical system lifespans. They are not a professional home inspection, appraisal, or guarantee of any system’s condition or performance. Always consult a qualified professional before making maintenance, repair, safety, or purchase decisions.
6. Your Content and Data
You retain ownership of the content and data you submit (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Service. You are responsible for ensuring you have the right to upload Your Content and that it does not violate any law or third-party right.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, scrape, or copy the Service except as permitted by law.
- Upload malicious code or content that infringes the rights of others.
8. Intellectual Property
The Service, including its software, design, logos, and content (excluding Your Content), is owned by Home Tracker and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. All rights not expressly granted are reserved.
9. Third-Party Services
The Service may integrate with or link to third-party services. We are not responsible for the content, policies, or practices of those third parties, and your use of them is at your own risk and subject to their terms.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any score or recommendation is accurate or complete.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOME TRACKER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR PROPERTY ARISING FROM YOUR USE OF THE SERVICE. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.
12. Indemnification
You agree to indemnify and hold harmless Home Tracker and its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will survive.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Florida, unless applicable law requires otherwise. You and Home Tracker agree to first attempt to resolve disputes informally.
15. Changes to These Terms
We may modify these Terms from time to time. When we make material changes, we will update the “Last updated” date and notify you where appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
